Sting? wtf?
« on: April 27, 2014, 04:40:11 PM »
Sooo just the other day my friend asked me to go to a party, and hell its friday why not? got some school done early and no work on sat. might as well relax till next week. So we go get a 24 pack of busch and head out. We get to the apartment and my friend who is also holding the pack knocks on the door. The 'Party host' opens the girl and its a chick, all the people here are actually older than i thought it would be so i walk in behind my friends, shaking 3 dudes hands saying whatsup. thats when the police come up behind me and handcuff me saying that i was charged with transfer of alcohol to minors, even though i hadn't touched the alcohol and didn't know she was under age. So i guess this is me ranting and wanting to know if you guys think this is bull**** as i do. In any case i plan on taking it to court and calling it as entrapment and also saying i didn't know she was under age and i also didn't touch it.

Let's examine the facts:

- Your friend invites you to a party

- This party is full of strange adults that you don't know.

- Your friend fails to mention she is underage

- turns out the party is a setup

- You get arrested for supplying alcohol to minors

Sounds to me like your "friend" set you up, which makes her seems like a bit of a twatwaffle, doesn't it? At the very least, this should strain your relationship.

Sorry i may have not explained it well. The friend who invited me to the party was not the chick, The chick was just the party host. As far as the strange adults thats what most parties are ;P the fact that she was underage was apparently supposed to have been clear and yet i had no idea(i dont mess around with younger chicks). But to say the least i am pissed at my friends but it wasn't really their fault.

Sounds like a lawyer could solve this relatively easy, and get any charges dismissed.

I think you better look up the statute that you're charged with. Use the Internet type in the statute number in the state and then read it and look for what's called the elements of the offense that is the key things that you have to do in order to violate statue. As it stands, you can't transfer alcohol to a minor if you don't give it to him to possess from that point forward. For example I could buy a bottle of liquor and my son can carry it for me even though he's 9 years old it's still mine he's just caring it for me. The question stands did you give alcohol to a minor to have and to hold. The fact that you brought some alcohol to a party reminder for presents does it mean that you transferred alcohol to them. Often times we go to peoples homes and their drinking alcohol in the house and they are still children there no one goes to jail for that because its not a crime. Maybe it's time for you to call a lawyer before you end up with the stupid felony charge that sticks.

Yeah i have been trying to look at some good defense attorneys so ive found a couple good ones. The cops said i should just basically roll over and do the Pre Trial Intervention program but thats some bs if you look at what you have to do. It takes 1 to 3 years which i'm not going through when i didn't do anything. And thanks man helps out alot, you sure know your stuff ;P.
